Aquabike Isle of Man Limited – Terms and Conditions

1. Important Information Before You Book

1a. Before taking part in any water sports activity you agree that:

Water sports activities are physically demanding activities which have inherent hazards associated with them. We take all necessary precautions to try to ensure the safety of all participants at all times.

Each participant should familiarise themselves with the hazards and try and minimise these as much as possible by complying with Aquabike Isle of Man’s pre activity safety brief and activity rules.

Furthermore, it is understood and agreed that individuals participate at their own risk. If you are unsure of your physical or mental ability to participate in an activity with Aquabike Isle of Man, we recommend that you consult your doctor.

1b. General Conditions of Service Applicable to All Sessions

Whilst every reasonable attempt will be made to deliver aquabike sessions, Aquabike Isle of Man reserves the right to cancel or modify any session due to safety considerations and factors beyond our control.

As part of the continual review of safety and associated considerations, the conditions of booking are subject to change, clarification and modification at any time. Only the Directors of Aquabike Isle of Man are empowered to vary or waive any of the conditions of booking.

If an activity is cancelled due to bad weather or any other unavoidable circumstances by Aquabike Isle of Man, your booking will be rescheduled to a mutually convenient date within twelve calendar months of the original booked activity.

Aquabike Isle of Man does not accept any responsibility for any consequential losses or out of pocket expenses or costs incurred as a result of cancellation. If traveling from afar we recommend all participants to have in place valid travel insurance before the date of departure.

1c. Health and Safety Considerations

Due to the physical nature of activities on offer with Aquabike Isle of Man, all participants must be physically able. Anyone with a medical condition or injury which may impede their ability to take part in aquabiking, should consult their medical practitioner to assess their ability to participate before making a booking.

Aquabike Isle of Man operates a policy of inclusivity; if you, or your group, have any specific requirements, we recommend that you contact us before booking to enquire about what we could offer and if we can accommodate your needs.

Aquabike Isle of Man will allow pregnant women, who have had no complications with their pregnancy, to participate at their own risk.

Pre-Booked participants must remain the same throughout the session. Places are non-transferable once the session has started.

Participants must arrive before the session start time to check in. All participants must attend a safety briefing and be issued and fitted with a buoyancy aid by Aquabike Isle of Man staff, failure to do so will result in you being unable to participate in this activity.

All participants must be able to swim and be confident in open water. For any participant under the age of 16 years old, a parent/guardian will be required to agree to their participation in activity sessions (they will be required to sign agreeing to these terms and conditions on behalf of the participant who is under 16 years old on the day).

Clothing/Footwear

We launch the bikes from the beach so participants should be prepared to get wet up to their knees. Lightweight, quick drying clothing is best, jeans are not recommended. Shorts or trousers that can be rolled up above the knee work well.

We recommend that secure footwear is worn for the activity. Wetsuit boots, water shoes/sandals or trainers are ideal (footwear will get wet). The pedals can be used barefoot but may not be comfortable for everyone!

Age, Size and Weight Restrictions

Participants must be aged 10 or over and minimum height of 1.4m (4ft 7in)
Maximum Chest and Waist measurement 135cm (53in)
Weight maximum for single rider 150kg (23 ½ stone)
Maximum combined Weight of both tandem riders 220kg (34 ½ stone)

Responsibility for Children

Children remain the responsibility of their parents or guardians at all times. If the parent or guardian is not accompanying the children on the water, they must remain at the harbour/beach area for the duration of the session.

2. Making a Booking

2a. Where possible, we recommend that you book in advance to avoid disappointment. You can book your aquabike sessions online, by phoning +44 7624 266221, emailing [email protected] or speaking to a staff member at the harbour. If booking online, your credit or debit card details will be requested to complete your purchase and a "print-at-home" ticket will be generated. Full payment, as itemised, shall be debited and your account statement will identify the transaction as "WebTicketManager".

2b. Pricing varies by product and is subject to change without prior warning.

2c. Payment can be taken via the online booking system. We also have a sumup card reader at the harbour which accepts payment by all major credit and debit cards, google pay and apple pay. We accept Sterling cash. Payment is required in full at the time of booking.

3. During Your Visit

3a. Please arrive arrive at the Aquabike Isle of Man meeting point in The Boat Park, Breakwater Road, Port Erin prior to your booking time. You will be asked to sign a Disclaimer acknowledging the risks and confirming your ability to participate. Parents and legal guardians must sign on behalf of children under the age of 16. You will not be allowed to participate in any activity without signing the Disclaimer.

3b. Acceptable Conduct

Behaviour will be monitored at all times. If you are disruptive in any way, deliberately ignore safety instructions or you’re suspected of being under the influence of alcohol or drugs, we reserve the right to remove you from the activity. No refund or compensation will be given.

3c. Equipment and Clothing

For safety reasons, a buoyancy aid must be worn by all participants for the duration of the activity.

3d. Accidents

Report all accidents to a member of Aquabike Isle of Man staff so that we can provide necessary assistance. Any accidents will be recorded in our accident book. We have first aid facilities at the harbour meeting point, please ask a member of staff if you require any first aid.

3e. Damage

All damages to Aquabike Isle of Man property either accidental or deliberate must be reported to a member of Aquabike Isle of Man staff. Damage to or loss of equipment caused by negligence, malicious acts or carelessness must be paid for at the time at current replacement value.

3f. Parking

There is free public parking available on the Port Erin promenade. This can fill up quickly so please allow plenty of time to find a parking spot before your session. You may need to park in the village and walk down to the harbour meeting point.

3g. Smoking

Smoking (including e-cigarettes) is not permitted from initial registration to completion of activity.

3h. Liability and Insurance

Aquabike Isle of Man holds public liability cover.

Aquabike Isle of Man accepts no responsibility whatsoever for any loss or injury resulting from any persons’ involvement in any activity except where injury is caused by the negligence of Aquabike Isle of Man or its employees or volunteers.

Aquabike Isle of Man is under no liability whatsoever in respect of loss or damage to property, however caused, whilst you are participating in activities.

If traveling from afar we highly recommend that you take out personal travel insurance to cover any consequential losses due to any unforeseen damage to property or cancellation of sessions.

4. Important Information

4a. Photography.

From time-to-time Aquabike Isle of Man carries out photography and/or video recording during activities, which may feature participants. Copyright of these materials rests with Aquabike Isle of Man. If you're lucky enough to be photographed whilst attending any of our activities, your photograph may be used as promotional material on Aquabike Isle of Man’s social media channels or on our website. No royalties or compensation will be paid in the event that your image is used by us.

If you'd prefer not to have your photo used for promotional reasons, please tell a member of staff prior to your session.

4b. Refund and Cancellation Policy

We need at least 28 days notice of any cancellations. Cancellations within 28 days are not eligible for a refund. Bookings that are missed and groups/individuals who arrive late for any reason will not be entitled to a refund.

Privacy Policy

WebTicketManager is a product that provides web-based technology and systems enabling the online transactional relationship between the venue (ticket provider) and its customer (ticket purchaser) and is committed to preserving the privacy of all data collected during the process. We undertake to comply with applicable UK data protection legislation at all times. Please read the following Privacy Policy carefully to understand how we use and protect this information.

By using the WebTicketManager transactional system with any business using the WebTicketManager service, the Customer (ticket purchaser) consents to the collection, use and management of their information under the terms of this Privacy Policy.

Information that we collect from the Customer
When the Customer orders products or services from participating venues using the WebTicketManager service, he/she may be required to provide certain personal information including name, contact details and credit or debit card information. For clarity, WebTicketManager uses a secure 3rd party processor for all credit / debit card transactions and has no access to the detailed card information.

We may also collect information about the Customer's participation with businesses using the WebTicketManager service through the Customer's general usage of the system as well as from the participating venues themselves.

Use of Customer information
This section explains the uses to which personal data may be used in accordance with the WebTicketManager service.

Customer information will be available for use by WebTicketManager, the specific business supplying the goods and services to the Customer using the WebTicketManager system and, if the Customer has entered the WebTicketManager system through a Box Office portal, to the Box Office operator.

Customer information will enable the business to supply the goods or services that the Customer has requested. It will also enable us and businesses using the service to contact the Customer where necessary concerning their order or for other relevant reasons. The information collected will also be used and analysed to administer, support, improve and develop the WebTicketManager system.

In particular, participating businesses may be supplied with certain aggregate and statistical information obtained through the Customer's use of the system that will allow such businesses to analyse and improve their services, for instance, by the monitoring of general customer trends. Please note that such aggregate and statistical information will not include information that can be used to identify Customers. The Customer may also be contacted for his/her views on our services as well as occasionally notified of important changes or developments to the service.

One of the further benefits of a Customer providing his/her information is to enable us to let Customers know about other products and services on offer which may be of interest, including details of new attractions or discount offers. We may contact Customers by post, telephone or fax, as well as by e-mail or SMS. Customers have the option to opt out of this communication prior to purchasing the goods and services. Customers who change their mind about being contacted in the future must contact us as set out below.

Disclosure of Customer Information
The information provided by Customers will be held on secure computers in the UK and may be accessed by or given to webticket staff and third parties including participating businesses for the purposes set out in this policy or for other purposes approved by the Customers. Where Customers have consented when providing their details, participating businesses may also contact Customers occasionally about their products and services which may be of interest, including offers and promotions other than those available through the system. Such businesses may contact Customers by post, telephone or fax, as well as by e-mail or SMS. Customers who change their mind about being contacted by businesses in the future must contact Livesmart as set out below.

Please note that participating businesses with which the goods or services are used may use further information obtained by them to market or to update their own databases. Finally, if webticketmanager enters into a joint venture with or is sold to or merged with another business entity, Customer information may be disclosed to such new business partners or owners.

Unless required to do so by law, neither Livesmart, the business or, if applicable, the Box Office operator will not otherwise share, sell or distribute any Customer's information without such Customers consent.

Security and data retention
We employ security measures to protect Customer information from access by unauthorised persons and against unlawful processing, accidental loss, destruction and damage. Customer credit or debit card details will not be retained beyond the point of requiring them for the purposes of making the relevant payment for which such details were submitted. All other information will be retained for a reasonable period or as long as the law requires.
Accessing and Updating
Customers are entitled to see the information held about them and may request web ticket manager to make any necessary changes to ensure that such information is accurate and kept up to date, including details of what types of marketing such Customers would like to receive or not receive. Customers wishing to do this should contact webticketmanager either by e-mail or by post to the addresses set out below. A charge may be made for supplying a customer's records.

Changes to this Privacy Policy
Any changes to this privacy policy in the future will be posted to the site and, where appropriate, through e-mail notification.

Force Majeure
Except where otherwise expressly stated in this policy, we cannot, and will not accept liability or pay compensation where the performance or prompt performance of our contractual obligations is prevented or affected by, or you otherwise suffer any damage or loss, as a result of “force majeure”. For the elimination of doubt, in these conditions, “force majeure” means any event which we, or our sub-contractors, could not, even with all due care, foresee or avoid. Such events include, but are not limited to, war, threat of war, riot, civil strife, terrorism, industrial disputes, natural disaster, adverse weather, fire, etc.

Complaints & Disputes
Any disputes or complaints must be brought to our attention in writing no longer than twenty-one (21) days from the origin such. We shall then be granted an additional sixty (60) days to investigate and resolve such a dispute or complaint without involving third parties or outside solicitors, litigation or counsel.

In the event of a complaint or dispute not being satisfactorily resolved, both parties irrevocably agrees that the dispute will be settled and determined by final and binding arbitration pursuant to the United Kingdom and that such arbitration will be conducted in accordance with the Rules and Procedures in current effect under English law.
