TERMS AND CONDITIONS OF ENTRY

Walsall Scare Maze places great importance on the safety of its guests and endeavours to ensure that its high standards are met by all persons visiting the Attraction. Please assist us in ensuring our Attraction and its facilities remain a safe place in which to enjoy fun and exciting experiences. 

In these Entry Conditions, the following definitions shall apply:

Attraction - The Horror Maze(‘s) currently opporating at the time of the event;  

Walsall Scare Maze & The Scarehouse/’Us’/’We’ - Walsall Scare Maze

You are admitted to this Attraction subject to the following Entry Conditions.  If you do not comply with them you may be removed from the Attraction by Walsall Scare Maze personnel, security or police officers, without any right to a refund.  This is without prejudice to any claim that we may have against you or arising out of your actions.  Whilst inside the Attraction, you must comply with any reasonable instructions given to you by Walsall Scare Maze personnel or any third party instructed on behalf of Walsall Scare Maze.

By entering the Attraction, you accept that you have a duty to take reasonable steps to ensure your own safety, taking into account any personal medical conditions.  All persons in and around the Attraction should behave in a safe manner at all times.

You should NOT ENTER this horror attraction if you suffer from asthma, heart conditions, prone to seizures, photo-sensitive epilepsy, physical ailments, respiratory or any type of medical problem, are pregnant or suffer from claustrophobia.

DO NOT ENTER the attraction if you are wearing any form of cast, use crutches or have any type of physical limitations.

General:

For health and safety reasons (due to the topographical features of the Attraction), wheelchairs and other mobility devices are not permitted within the Attraction. Your personal items must be kept away at all times and you are responsible for the safe keeping of any item such as but not limited too mobile phones, smart watches/devices. Walsall Scare Maze staff, management and any other affiliates will not be held responsible for loss or damage to ANY personal items including clothing. You enter the attraction at your own risk of damage being caused to any items you bring or wear. Clothing may get wet, dirty, stained, ripped or damaged. Dress appropriately for the event. 

Our commitment to provide a service:

Walsall Scare Maze will endeavour to ensure that the attraction is available for use by guests during open hours.  However, Walsall Scare Maze reserves the right, without prior notice, to close and change the programme of rides and attractions and/or the Attraction's operating hours.  Walsall Scare Maze in its absolute discretion reserves the right to close the whole or any part of the Attraction at any time or to restrict the number of persons having access to the Attraction.  The reason for any closure or restriction provided by this condition may include technical or operational reasons, capacity, inclement weather, special events or to ensure the safety and security of guests or if Walsall Scare Maze reasonably considers the circumstances so require. If the whole Attraction is closed for any of the reasons set out above, Walsall Scare Maze reserves the right to offer substitute tickets for admission to the Attraction on an alternative date in substitution for any other form of redress.  

Our right to remove you:

Walsall Scare Maze, acting reasonably at all times, reserves the right to refuse admission to the Attraction, ban from entry to the Attraction, or remove from the Attraction without any right to a refund any person whose presence or behaviour may affect the enjoyment and/or safety of other guests or staff: or who acts in an inappropriate and/or undesirable manner whilst travelling to the Attraction whether by bus, coach or other means, where such behaviour has been reported to Walsall Scare Maze by a reliable independent source; has been convicted of a criminal offence relating to Walsall Scare Maze, or civil unrest at Walsall Scare Maze property/attractions; usesviolent, aggressive, threatening, abusive, discriminatory or insulting words or behaviour or in any way behaves in a manner which may provoke a breach of the peace; climbs or stands upon fences, barriers, walls, safety fences, ride/attractions structures, exhibits or any other buildings at the Attraction.  Walsall Scare Maze reserves the right to initiate legal proceedings or prosecute any person found damaging or defacing any part of the grounds, fences, barriers, walls, ride/attractions structures, exhibits, fabrics or buildings at the Attraction or has displayed any sign or visible representation of any kind which is, or could be reasonably judged to be, threatening, abusive or insulting or  has previously acted in any manner which has caused any person to report that individual to Walsall Scare Maze; or is attempting to regain admission to the Attraction or has been found inside the Attraction without a valid Ticket; or has purchased or obtained any tickets or discount vouchers from a ticket tout or Walsall Scare Maze reasonably believes that they have purchased a ticket from an unauthorised source. Whilst inside in each attraction, actors/staff will interact with you. They may touch, grab, manoeuvre and restrain you, whilst it is done in a safe and controlled manor, you ARE NOT to touch, use violent, aggressive, threatening, abusive, discriminatory or insulting words or behaviour towards any of the actors and/or staff. If any guest in breach of any of these Entry Conditions is a member of a group, then such group of individuals may also, at Walsall Scare Maze's discretion, be denied entry or escorted from the Attraction without any right to a refund.

Tickets/admissions:

THE ATTRACTION IS PRIVATE PROPERTY. All persons entering the Attraction must pay for admission or hold a valid ticket. The sale of tickets/vouchers by anyone other than Walsall Scare Maze is strictly prohibited. Only persons authorised by Walsall Scare Maze are permitted to sell or offer for sale any items to guests within the Attraction grounds. All tickets are non-transferable, not for resale and will become automatically void on any transfer for value. Tickets purchased are only valid on the date printed on the ticket. Tickets may not be valid for special events which may attract a separate admission fee. Tickets will only be exchanged or refunded if Walsall Scare Maze, in its absolute discretion, chooses to do so. For the avoidance of any doubt, pre-booked tickets are non-refundable in the event that admission is refused or relinquished for any reason referred to in these Entry Conditions Tickets booked online will be delivered in accordance with Walsall Scare Maze's delivery procedure. If tickets are bought on behalf of other guests, the buyer accepts these Entry Conditions on behalf of every guest and shall ensure that these Entry Conditions are complied with by each person in the group.If re-entry into the Attraction is required, an appropriate hand-stamp or ticket must be obtained, before exiting the Attraction which must be shown at the time of re-entry to regain access. Tickets must be retained at all times and submitted for inspection if required by Walsall Scare Maze.  No child or children the age of 12-17 will be admitted to the Attraction unless they are accompanied by an adult aged 18 years or over and such child or children whilst on site must remain under the control or supervision of an adult at all times. Walsall Scare Maze reserves the right, in its absolute discretion to change the age restrictions referred to in this condition, if any particular circumstances so require in the interests of safety and security.  

Your behaviour:

Unnecessary noise or any behaviour likely to cause annoyance to other guests or confusion of any kind is not permitted in any part of the Attraction. Smoking (including of e-cigarettes) is strictly prohibited other than in the designated smoking areas identified.  All rides, attractions, amusements and any other facilities located at the Attraction must only be used in accordance with the relevant operator's instructions.

Your dress & appearance must be suitable for a family attraction:

You must wear appropriate clothing (including a top and shoes) at all times whilst at the Attraction. If you are wearing clothing that is indecent or likely to cause offence in any way, you will be refused entry or removed from the Attraction.  Stilettos and loose clothing are not allowed on some rides/attractions due to health and safety reasons, Walsall Scare Maze will NOT be held responsible for any loss or damaged caused to items of clothing or personal belongings whilst visiting the attraction, either in the attraction its self or within the grounds of the attraction. 

Security:

To prevent offensive weapons or dangerous articles from being brought into the Attraction, you are admitted to the Attraction subject to the condition that, if requested to do so, you will allow yourself and/or your belongings to be searched.  It is prohibited to bring into the Attraction any weapons, fireworks, smoke bombs, glass bottles or other articles which may cause injury. The throwing of any article which could cause injury or affect the enjoyment of other guests is strictly prohibited.   Any person found to be in possession of an article deemed to be offensive or dangerous will be immediately escorted from the Attraction without any right to a refund and Walsall Scare Maze reserves the right to make reports to the relevant authorities which may lead to prosecution. The consumption of intoxicating liquor is permitted only in authorised places within the Attraction.  Accordingly, intoxicating liquor may not be taken into the Attraction except with the express permission of Walsall Scare Maze and any persons found possessing alcohol, or who appear to be under the influence of alcohol may be refused admission to the Attraction or escorted from the Attraction without any right to a refund.  The use of illegal substances is strictly prohibited and any persons found possessing, using or who appear to be under the influence of illegal substances will be refused admission or escorted from the Attraction without any right to a refund. CCTV cameras are used to assist in the proper running of the Attraction. However, we do not make any representation as to the extent of coverage provided by the cameras. All items, belongings and other property brought into the Attraction by you are at your own risk and we accept no liability for any loss or damage to such property. As such, we recommend that you do not bring valuables to the Attraction.

Photography:

Whilst inside an attraction you are NOT permitted to take photographs and recordings within the Attraction. You are permitted to take photogrphs and recordings within the waiting areas and other public areas of the site provided that these are solely for private use and are not sold or used for any commercial or public purpose. By accepting these Entry Conditions, you acknowledge that Walsall Scare Maze may on demand have access to photographs taken and video footage captured by you and request that certain photographs and/or footage are deleted if they are deemed to be offensive to or infringe the privacy of other guests and/or staff. By accepting these Entry Conditions, you agree not to intentionally photograph and/or capture video footage of any individual without that person’s permission and you must adhere to all photography/filming restrictions in place from time to time whilst within the Attraction. From time to time Walsall Scare Maze or other authorised parties carry out photography and/or video recording in the Attraction, which may feature guests. Entry to the Attraction is deemed acceptance of these Entry Conditions, and you therefore agree that Walsall Scare Maze or any authorised party may use such images in perpetuity in any promotional, advertising or publicity material in any format whatsoever. You further agree that copyright in these materials rests with Walsall Scare Maze or such authorised party (as the case may be).

Queuing

Whilst Queuing to enter the site, or for one of the attraction/stalls you must adhere to all rules shown in the queue line as well as these standard rules. Queue jumping is not permitted at anytime. Definitions of this are, cutting in-front of people already in the queue. Leaving the queue and then attempting to re-join at the same place, regardless of whether or not you place has been reserved. If you and your party arrive at different times, and the persons who arrived first are already in the queue, you must join the back of the queue. That is to say you are not permitted to join the queue with the others in you party already in the queue. Each individual attraction/stall will have their own queue. You must join the back of each one as you arrive to the attraction/stall.

There are always going to be queues with this type of attraction. We cannot at any point guarantee any queue times. Should you choose to leave the queue, you do this at your own discretion, as stated before, if you choose to re-join the queue, you must do so by re-joining at the back. If you are leaving the queue due to other engagements you have and you wish to come back on another day, you will be allowed to use your ticket on another day at the discretion of management. No refunds will be offered. If you do not comply with these rules you may be removed from the site by Walsall Scare Maze personnel or security without any right to a refund

Liability

By purchasing a ticket you are excepting the liability and inherent risks involved.

In so far as our duties extend in providing a professional, safe and
fit-for-purpose product, we, our staff and our agents shall not be liable
for any injury, loss, expense, damage, accident, delay, irregularity,
stranded individual, personal negligence, weather, quarantines, sickness,
disease, act of God, Government restriction, legal regulation or otherwise
which are adjudged to be out of our control.

We, our staff and our agents shall not be liable for any injury, loss,
expense, damage, accident, delay, irregularity, stranded individual,
personal negligence, weather, quarantines, sickness, disease, act of God,
Government restriction, legal regulation or otherwise for any individual or
company furnishing sub-contract services, transportation, attractions,
accommodation or any other product or service related to Walsall Scare Maze.

These Terms and Conditions constitute a formal agreement between us and our
Customer (this being the person(s) who uses our products and/or services).
We and our Customer(s) accept and agree to be legally bound by these Terms &
Conditions. A credit or debit card guarantee, full or part payment and
acceptance of such by us for you to use our products and/or services
signifies an understanding and acceptance of these Terms & Conditions.

Reservations
Advance reservations and/or ticket purchase is recommended to prevent
disappointment. Such reservations can be made through this website.

Booking Guarantee
Your credit or debit card details will be requested to purchase your
ticket(s). If booking online, your credit or debit card details will be
requested to complete your purchase and a "print-at-home" ticket will be
generated. Full payment, as itemised, shall be debited and your account
statement will identify the transaction as "WebTicketManager".
This is our 3rd party payment clearing provider who operate our secure, PCI
compliant online booking system and can be contacted directly at: Wincham

If booking by any means other than online, your credit or debit card details
may be requested to complete and/or guarantee your reservation. Payment, as
detailed, shall be debited accordingly and your account statement will
identify the transaction as “WebTicketManager".

If booking through an approved representative, payment will be taken in
accordance with their own terms and conditions of ticket sales. Your
reservation is duly guaranteed by the issuing of a payment receipt or tour
ticket(s).

Where payment has not been completed, we may, at their discretion,
provisionally reserve your ticket(s) but reserve the right to re-allocate
them should another client request and secure them by payment. In this case,
you shall be duly notified and given the chance to complete your payment.

Cancellation by the Customer
We regret that our cancellation policy does not permit the cancelation of
ticket(s). Your statutory rights are not affected.

Cancellation by Us
Where we cancel, for whatever reason, and an alternative cannot be offered
or taken, a refund in full (if applicable) shall be made within ten (10)
working days of such a cancellation being confirmed.

Compensation will not be payable and no liability will be taken where we are
forced to cancel as a result of unusual or unforeseeable circumstances
beyond our control, the consequences of which we could not have avoided even
with all due care. No compensation will be payable if we cancel as a result
of your failure to comply with these terms. No additional compensation,
consequential losses, additional travelling costs or other such claim shall
be accepted in such an unfortunate event.

Booking Amendments
Wherever possible, a booking amendment shall be accommodated without charge
or penalty if requested fourteen (14) days or more prior to the event date.
An administration charge of 10% of the net booking value shall be payable
for all amendments made less than fourteen (14) days prior to the event date
if such an amendment is possible.

Where an amendment cannot be made and the original booking cannot be
fulfilled, then the Cancellation Policy detailed above shall be applicable.

Prices Quoted
Prices quoted shall be current at the time of booking, acceptance and
acknowledgment. The price agreed shall not be subject to any change unless
forced due to circumstances beyond our control. Such circumstances shall
include civil riot, region or National emergency, war, route closure, severe
weather conditions, etc. Where such a price amendment is necessary, you will
be notified in writing no less than twenty-eight (28) days prior to your
event date. Should a price amendment be unacceptable, the booking may be
cancelled in accordance with our Cancellation Policy above but without
penalty or administration charge if confirmed as cancelled fourteen (14)
days or more prior to the event date.

Price Inclusions
Your ticket price shall include goods and/or services as indicated,
statutory insurance, VAT, all taxes and anything specifically mentioned as
"included".

Price Exclusions
Your ticket price shall exclude personal insurance, snacks, lunch,
beverages, optional activities, gratuities and any other items not
specifically mentioned as being included.

Concession Requirements
As a general rule, bookings will be accepted at face value at the time of
booking. However, at our discretion, proof of any concession entitlement
claimed may be requested at any time during fulfilment of the booking. Such
proof shall include any legal document that contains a recognisable
photograph and date of birth. Failure to produce such evidence upon request
may result in the concession being withdrawn and payment being requested
amounting to the difference between what has already been paid and the full
published price.

Attractions, Highlights & 3rd Parties
Attractions, highlights and 3rd parties experienced during fulfilment may
have specific reservation rules, payment procedures, health & safety rules
and terms & conditions which shall be applicable in full in conjunction with
these terms & conditions.

As in any product and service of this type, you are entirely responsible at
all times for your own safety and for that of others. Going off any unmarked
pathways, through closed gates, barriers or otherwise is done so entirely at
your own risk and no responsibility can, or shall, be taken in such an
instance. If in doubt, please ask.

Children
Children under the age of fourteen (14) shall be accompanied by an adult at
all times. Full responsibility for children remains with the accompanying
adult, including general behavioural control so as not to disturb the
others.

Special Needs
Please contact us to discuss specifically your needs if you are disabled or
a special need client requiring a wheelchair or other such mobility
assistance and/or special assistance. It is our intention to operate
access-for-all and we will make every effort to accommodate special needs
accordingly. We reserve the right to require persons who are unable to move
independently to be accompanied by a companion who is able to provide any
necessary assistance and take full responsibility accordingly.

Animals / Pets
Animals and pets shall not be permitted with the exception of a registered
and documented guide dog in accompaniment of a visually impaired person.
Full responsibility for such an animal remains with the accompanying person,
including feeding, hygiene and general control so as not to disturb the
other passengers.

Comfort
For the comfort and safety of all, alcohol, & tobacco is strictly
prohibited at all times other than in designated areas. Alcoholic beverages
can only be purchased on-site and not brought through the ticket entrances
in either direction. Non-prescribed drugs are strictly prohibited and we
operate a zero-tolerance policy that will involve the police without
hesitation.

Insurance
We operate within UK laws that include compulsory and statutory insurance
against accident and third party liability. Personal insurance against
injury, item theft, loss, or any other such event is not included and it is
highly recommended that you take out your own Travel Insurance in good
standard travel procedures.

Overall Enjoyment
We will not accept responsibility for your overall enjoyment. Whilst every
effort will be made to maximise your pleasure and experience, it is accepted
that every person's preference and tastes are unique and it would be
impossible to satisfy all of our customers all of the time. However, we
recognise that our own success is dependent on word of mouth referral and
prioritises customer satisfaction accordingly.

Liability
In so far as our duties extend in providing a professional, safe and
fit-for-purpose product, we, our staff and our agents shall not be liable
for any injury, loss, expense, damage, accident, delay, irregularity,
stranded individual, personal negligence, weather, quarantines, sickness,
disease, act of God, Government restriction, legal regulation or otherwise
which are adjudged to be out of our control.

We, our staff and our agents shall not be liable for any injury, loss,
expense, damage, accident, delay, irregularity, stranded individual,
personal negligence, weather, quarantines, sickness, disease, act of God,
Government restriction, legal regulation or otherwise for any individual or
company furnishing sub-contract services, transportation, attractions,
accommodation or any other product or service in connection with a our goods
and/or supplies.

It is clearly stated, understood and agreed that, to the fullest extent to
which liability may be excluded or avoided, We will have no liability,
whether in contract or otherwise, for any losses, costs or damages, and in
no event will be liable for any direct, indirect, incidental, special,
punitive, expectancy or consequential damages, even if they are foreseen or
foreseeable, arising or resulting from, or related to, our services and
products.

In all cases, the maximum liability payable shall not exceed the total fee
collected for the provision of the goods and/or services provided.

Warranty
We provide our service strictly on an "as is" basis without warranties of
any kind, either express or implied, including, but not limited to, the
implied warranty of fitness for a particular purpose. Your UK statutory
rights are unaffected by our Warranty terms.

We are not responsible for, provide no representations to, warranties or
guarantees with respect to, and will not be held liable in any way for any
content, information, services or material on any third party supplier,
including, without limitation, any third party recommended, named or
utilised by us.

It is clearly stated, understood and agreed that, to the fullest extent to
which warranty may be excluded or avoided, the maximum warranty payable
shall not exceed the fee collected for the provision of the goods and/or
services provided.

Reserved Rights
The right is reserved to make operational changes at any time, whether to
the goods, services, itinerary or otherwise, with or without notice, which
is considered necessary prior to the event.

The right is reserved to cancel any booking at any time, should conditions
or circumstances necessitate, offering substitutes of equal value or a full
refund without administration charge or penalty as detailed under our
Cancellation clause above. If circumstances warrant such action a full and
documented reason shall be provided.

The right is reserved to require persons who are unable to move
independently to be accompanied by an adult companion who is able to provide
all necessary assistance and take full responsibility accordingly.

The right is reserved to decline to accept, or retain, any person at the
discretion of the management. If circumstances warrant such action a full
and documented reason shall be provided and an equitable cash amount without
penalty or administration charge shall be refunded in accordance with our
Cancellation clause above. In such an instance, it shall be client's sole
responsibility to travel further. No compensation, consequential losses,
additional travelling costs or other such claim shall be accepted in such an
unfortunate event.

Reasons for such action shall include, but not be limited to:
- Violent, racist, verbal abuse or other such unacceptable behaviour.
- Failure to comply with the laws of the United Kingdom.
- Drunk and disorderly behaviour.
- Misuse of un-prescribed drugs.
- Refusal or failure to comply with health & safety issues.
- Refusal or failure to provide suitable evidence of entitlement to partake
in a tour.
- Refusal or failure to pay the correct fee for taking a tour.
- Any other behaviour deemed disruptive, dangerous or insulting to other
passengers.
The right is reserved to re-allocate an unsecured booking at any time.

The right is reserved to make alterations or changes to these Terms &
Conditions at any time, ensuring that customers with existing bookings
receive the latest copy prior to taking their booking. Should the revised
Terms & Conditions be unacceptable to a pre-booked customer, the booking may
be cancelled without penalty or administration charge as detailed under our
Cancellation clause.

Force Majeure
Except where otherwise expressly stated in these conditions, we cannot, and
will not accept liability or pay compensation where the performance or
prompt performance of our contractual obligations is prevented or affected
by, or you otherwise suffer any damage or loss, as a result of "force
majeure". For the elimination of doubt, in these conditions, "force majeure"
means any event which we, or our sub-contractors, could not, even with all
due care, foresee or avoid. Such events include, but are not limited to,
war, threat of war, riot, civil strife, terrorism, industrial disputes,
natural disaster, adverse weather, fire, etc.

Complaints & Disputes
Any disputes or complaints must be brought to our attention in writing no
longer than twenty-one (21) days from the origin such. We shall then be
granted an additional sixty (60) days to investigate and resolve such a
dispute or complaint without involving third parties or outside solicitors,
litigation or counsel.

In the event of a complaint or dispute not being satisfactorily resolved,
both parties irrevocably agree that the dispute will be settled and
determined by final and binding arbitration pursuant to the United Kingdom
and that such arbitration will be conducted in accordance with the Rules and
Procedures in current effect under English law.

COVID 19

In the event of a temporary closure of the attraction or event, all valid tickets will be able to be moved to the next available open day and time or will become available to use on the next event. This is subject to availability and discretion of Wasall Scare Maze.

In the unfortunate event that you or one of your party cannot attend due to COVID 19. Walsall Scare Maze will do their best to re-book you and your group for another date and time subject to availibilty. NO REFUNDS will be issued in the event you or a member of your party does not attend due to any reason including COVID 19.

PLEASE DO NOT ATTEND THE EVENT IF YOU OR ONE OF YOUR GROUP ARE SHOWING SIGNS OR HAVE SYMPTOMS OF COVID 19. CHECKS WILL BE IN PLACE BEFORE ENTERING THE EVENT AND ATTRACTION.
